For first problem go to tools and select standby mode. then select off ur standby mode. then it become ok. and for second problem ur battery is not good then plz change it.
Oll what you need is format your mobile by pressing
*#7370# then enter yoursecurity code then mobile will restart and evry thing will be ok
note : you will lose oll your data so backup it first
Do take it back if you can. They willl repair it and give it back to you. Also ask them to upgrade the firmware. Its a very good model if handled properly. Very smart too. Specially the red one. Do use it with unlimited usage GPRS plan. I had one which my son took away.
